Kingston · July 21, 2026
Good evening everyone and welcome to tonight's meeting of the
Committee of Adjustment. Before we begin, I ask everyone to
please silence their cell phones. If you need to take
a call during the meeting, please step outside the room
before answering. If you are attending in person and have
an interest in the application being considered this evening, please
complete one of the sign - up sheets located inside
the main entrance. If you wish to receive notice of
the committee's decision or be notified of any Ontario Land
tribunal appeal, you must submit a written request. Those attending
in person can complete the forms available at the back
of the room. Those participating virtually may email our secretary
treasurer, Lindsay Staman at LSTHAMAN at city of Kingston. ca.
This evening will be, we will follow the same five
steps process for each application. First, I will introduce the
application and invite the applicant or their agent to the
speaker's podium, or to speak virtually. I will ask them
to state their name for the record and provide any
additional information they wish the committee to consider. Next, the
committee members will have an opportunity to ask questions of
the applicant, their agent, or staff. Then I will open
the public portion of the meeting. Members of the public
will be invited to speak in person or virtually. Please
state your name for the record before speaking. Each speaker
will have five up to five minutes. During this portion,
of the meeting, comments and questions will be received. Responses
will be given once the public portion has closed. It
is the fourth step that the applicant, their agent, or
staff, will respond to the comments and questions received during
the public portion of the meeting. Finally, the committee will
consider a motion and make its decision. This process will
be repeated for each application on tonight's agenda. And I
will now ask The Clerk if we have quorum present.
Thank you through you, Mr. Chair. I can confirm that
we do have Corum absent this evening is Peter Scebo,
Grevo Rohan, and Jordan Takenos Levy. Okay, thank you. So
with confirmation that we have Corum, I will call the
meeting to order at 532 p. m. Do we have
a mover and a seconder to approve the agenda with
the addendum, move by Councilloc, second by Doug. All those
in favor. And that passes. So I need a mover
and secondary to approve the agenda with the addendum. Oh,
that's why I just did that. I gotta do my
check marks, that's why. Do we have a mover in
saying they were to confirm the minutes of the committee
of adjustment meeting number 2026 - 07 held on Monday,
June 15th, 2026, moved by Somnath, seconded by Ken? Are
there any edits? No, okay, all in favor. And that
passes. So are there any disclosures of pecuniary interest. Sing
as none, there are no requests for deferral. There are
no returning deferrals, differral items. So moving on to business,
our first item of business in an application for permission
at nine Cataraqui Street. Can I have the staff, can
I have staff read this into the record. Through you,
Mr. Chair, this is an application for permission at nine
Cataracway Street. The file number is D13026 2026, and it
is to build and expanded two unit dwelling on the
approximate footprint of the previous dwelling. Okay, thank you. Do
we have the applicant here today. Oh, yeah, so if
you could come up to one of the, I guess
you can come over here to one of the mics.
So can you please state your name for the record.
Paul Ho. And do you have anything we wish to
add to the application. Not at. This point. No. Okay,
so committee members, do we have questions for the applicant
or staff. Seeing as, oh, Doug. Through you, Mr. Chair,
to staff. I just wanted to ask a question on
the recommended conditions. I don't understand, number five, what they're
talking about road widening there. Through the chair, our development
engineering group identified that we're deficient in the road right
- of - way in that location. And so they've
asked to take a three metre widening off the front
of the property. And the applicant has been helpful so
far in identifying that on their plans. Uh, so the
city will ultimately take three metres from the front of
the property, and they still have the balance of the
property for their proposal.
Through the chair, yeah, that's correct. The front three metres
of the property would be city property. And by extension,
if you see the concept plan, will the applicant is
proposing to relocate the HOME three metres further back? That's
part of the reason for the approximation of the location
on the property. You're Mike's not on. Your mic's not
on. So that's going to happen for the other people
along that same stretch. Through the chair, the road -
widings are generally taken at the time when the planning
act application for property. So in time, it's entirely possible
that the city would acquire equally on either side of
a right - of - way to eventually get to
the 20 metre right away. Okay, are there any other
questions or comments? All right. So seeing, uh, so now
I will open the public portion. Are there any members
of the public wishing to speak to the application for
permission at nine cataraqui street? Now ask for you to
raise your hand if you're in the room. If anybody
wishes to speak. Okay, so I'll go online. Is there
anyone online wishes this week to nine cataract street? Please
raise your virtual hand in zoom. Sing as none, so
close the public portion. Um, so now I'll come back
to the committee for a motion. Move my Ken, seconded
by Councillor Sanic. Um, is there any discussion. All those
in favor. And that passes unanimously. Okay, so we'll move
on to the next application, which is for permission at
102 Fraser Street. And can I have staff read this
into the record? Drew, you, Mr. Chair, this is an
application for permission at 102 Fraser Street. The file number
is D13032 2026. And it is to allow a self
- storage facility. Okay, do we have the applicant here
today. Or maybe the applicants online are their agent. They're
online. Okay. Okay, so can you state your name for
the record. Mr. Chair. Uh, my name is Chris Pertado
of CSPACE Architecture. The agent architect for this project. Um,
I'm accompanied by Gregory Irons of Jim's Gate Inc. the
prospective purchaser of the property. We've been working with SV
planning, Inc. as well. Okay. Do you have anything to
add to the application. Uh, three, Mr. Chair. I'll just
lay it out quickly. Our request for zoning relief would
permit the existing self - storage facility, which currently occupies
approximately 1, 320 metres square of the building to expand
throughout the entire structure, which is about 2, 880 metres
square. The application also seeks formal recognition of the existing
legal nonconforming self - storage use and permission for its
expansion within the existing building. So the current use of
the land were established under the M6 Industrial Zone under
bylaw 8644. The current uses include an auto repair centre,
a warehouse, and self - storage facility. At the time,
these uses were established, Alba were permitted under the M6
zone, including the self - storage use, which was permitted
as an accessory use to a permutated use. So the
expansion of the self - storage used throughout the existing
building. Would result in more efficient use of the property.
It would consolidate the exterior signage. Architectural language established consistent
operating hours for a single business and reduce overall vehicle
trips, noise, odour concerns, and outdoor storage compared to the
existing auto repair and warehouse uses. So these improvements would
create a use that is more compatible with the surrounding
area in the intended function of the lens. And retrofitting
the existing building would also support its continued occupancy, minimize
vacancy and make effective use of the existing infrastructure municipal
services. So in conclusion, it's our opinion that establishing the
self - storage use on the lens would represent a
more compatible legal non - conforming use. Than the use
is permitted under the URM 11 zone. And we better
suited to the surrounding area. It would also reduce the
traffic noise odour outdoor storage and other operational activities, minimizing
potential adverse impacts upon the property, and they bring neighbouring,
uh, uses and neighbours. We're thankful for the town's planning
support, and we agree with the conditions listed and exhibit
A. We can, uh, take any questions if you'd like.
Okay, thank you. Um, do we have any members of
the committee who have any questions or comments. I don't
see some. Okay, so then we'll go to the members
of the public. Any members of the public president wishing
to speak to 102 Fraser Street. Please raise your hand.
And if you're in the room. Sing as none. Alright,
so online, is anybody online wishing to speak to 102
Frazier Street? Please raise your virtual hand in Zoom.
Not seeing anyone. Alright, so. Now I guess we'll come
back to the committee for a motion. Move by Councillo
Sanic, seconded by Doug is there any discussion. Seeing SNON
all in favor. And that passes. Thank you, Mr. Chair
and Committee. Okay, you're welcome. Alright, so our third application
is for Minor variants and consent for 271 and 275
Helen Street. And can I have staff read into the
record, please? Through you, Mr. Chair, this is an application
for Minor variants and consent at 271 and 275 Helen
Street. The file numbers are D1012 2026 and D13030 2026.
The Minor variance application is to seek relief from the
aggregate interior setbacks for each residential building for the retained
and severed lot. And to reduce the minimum required interior
setback for the residential building, reduce the minimum required interior
setback for accessory buildings to reduce the minimum setback for
architectural features and to reduce the minimum landscaped open space
for the retained lot. The consent application is to sever
approximately 900 square metre parcel with a lot frontage of
approximately 24. 3 metres along hellent street. Okay, do we
have the applicant or agent here. With us. I guess
I'm online. Okay, yeah. So if you can state your
name for the record. Yep, my name's Tomlinkback. I work
for the boulevard group as the agent. Okay, and do
you have anything to add to the application. Nothing in
particular at this time. Okay, so committee, is there any
questions or comments. I don't see some. No? Okay, so
now I'll open the public portion. Um, is there anyone
in the public who wish to speak to 271 and
275 Helen Street? Okay, yeah. So if you could just
come to. Yeah, so if you could just state your
name and then you have five minutes. Yeah, it's great.
Samuel. What else? Just my name? Yep. Oh, 225 Park
Street. Um. I don't know if the variance is, are
the variants requested or are they just a part or
are they just a part of making, when it's divided
to the variance, this change, or is this a requested
thing? That's my first question. Does that make sense. Yep.
The second one. If the setbacks are changed, does that
mean a possible height. Could be changed too for a
new building. Yeah. All right.
Thank you. Is theone else in the room wish to
speak to this file. Just 271, a 275 Helen Street.
Okay. Um, and is there anyone online who wish to
speak. To this file? Okay, seeing as none, so I'll
go back to the applicant or staff to answer. Uh,
through you, Mr. Chair, a budding properties have merged inadvertently
as of June, 2022. And the purpose of the consent
is to allow both properties to be separately conveyable for
two separate lots. Um, in order to facilitate the consent
variance is our required for both the retained and severed
lot. Um, so with respect to if the variances are
required or requested, um, they are required in order to,
um, several the lot. Um, the setbacks, um, which include
setbacks with respect to the accessory structure, architectural features, uh,
interior setbacks and landscaped open space. Right now, the current
zoning by law, um, the existing setbacks don't comply with
the zoning bylaws. So, um, through this report and through
the variances, um, we would like to, um, bring all
of these, um, elements into compliance. Um, the second question
is, um, will be there at BNA changes with respect
to the height. Through the application and through their planning
justification, that was submitted by the applicants, no new development
is proposed at this time. So there will no be
exterior changes, no additional developments with respect to accessory structures
or so forth. Um, so no development is proposed at
this time. This application is just, uh, recognise or reestablish
the previous boundaries of the original lots located at 271
and 275 Helden Street. Thank you. Okay. Well, thank you.
Um. So now we are at the. So I will
ask, um, I guess we'll go back to the committee.
And if there's any, um, somebody wants to move and
second. Move back Councillo Sanic, seconded by some LaS. Is
there any discussion. No, all in favor. And that passes
unanimously. Okay. So next we have an application for Minor
variant 76 Gore Street. Can I have staff read this
into the record. Through you, Mr. Chair, this is an
application for minor variants at 76 Gore Street. The file
number is D13029 2026. And it is to expand a
rear third story dormer. Thank you. Do we have the
applicant or agent here today? Okay. So if you can
come up.
You can state your name for the record. Yeah. Mike
Preston, uh, I'm the agent for Lisa Kerr's, the owner
of 76 Corps. Okay. Do you have anything to add
to the application. Uh, only that we went to Heritage
Last week and it was approved unanimously. Um, also we
went for the same variant for the attached house about
three years ago. Same process. And it was approved. And
yeah, that's about it. Okay. So, um, do committee members
have any questions. For the applicant or staff. Seeing as
none. So I'll move on to the public portion. Is
there any members of the public wishing to speak to
the application for minor variants at 76 Gore Street? I'll
ask you to raise your hand if you're in the
room. Sing as none, um, is anyone online wishing to
speak to this file, which is 76 Gore Street. Please
raise your virtual hand and zoom. Sing as none. Um,
so now I will come back to the committee for
a motion. Anybody want to move my Ken seconded by
Doug is there any discussion. Singastan all in favor. And
that passes. Thank you. Okay. So our fifth item of
business is an application for minor variants at 2193 Unity
Road. And can I have staff read us into the
record. Through you, Mr. Chair. This is an application from
minor variants at 2193 Unity Road. The file number is
D13027 2026. And it is to construct a new detached
garage at a reduced interior setback. Okay. Um, do we
have the applicant here today? Oh, there you are. All
right. So, uh, just state your name for the record.

Okay. So do you have anything to add to the
application? Just one thing. Condition five. That's in the COA
report is the, uh, building permit for the detached home.
That building permit was approved in June. 24. And that's
all. Okay. Thank you. So do we have any questions
from the committee. Sing as none? We'll move on to
the public portion. Is there any members of the public
present wishing to speak to, uh, minor variants for 2193
unity road. Please raise your hand. Anyone online? If anybody
online wishes to speak to 2193 unity road, please raise
your virtual hand in zoom. Seeing as none, so I
will go back to the committee for a motion. Um,
move by Ken, seconded by some last. Is there any
discussion. No, all in favor. And that passes unanimously. All
right. So next we have an application for Minor variants
at 61 Livingston Avenue. And can I have staff read
this into the record. Mr. Chair. This is an application
for minor variants at 61 Livingston Avenue. The file number
is D13 024 2026. And it is to construct a
two story rear edition. I'll also note that tonight's addendum
contains one letter of support for this application. Okay. Thank
you. Do we have the applicant or agent here today.
Uh, yes, I'm here. Okay. You cannot start my video
because somebody is able that. Oh, there we go. Okay.
Just state your name for the record. My name is
Nier Rottenberg. I'm the owner. Okay. And do you have
anything to add to the application. No, thank you. Okay.
So the committee members have any questions. I don't see
some. Seeing as none. So I'll open the public portion.
Is any members of the public here today wishing to
speak to this application, which is 61 Livingston Avenue. Please
raise your hand or your virtual hand in Zoom. I
think it's not online if you wish. Please raise your
virtual hand and zoom. Okay. So seeing as none. So
I'll go to the committee for emotion. So move by
Doug, second by Councillo Sanic. Is there any discussion. All
in favor. And that passes unanimously. Okay. So finally our
last application is an application for minor variants at 22
Marley Street. Can I have staff read this into the
record. Through you, Mr. Chair, our last application tonight is
an application for minor variants at 22 Marlee Street. The
file number is D13031 2026. And it is to reduce
the front setback from 5. 9 metres to 4. 1
metres. Okay. Do we have the applicant or agent here
today. Hello. I'm the agent on behalf of the honours.
Ashley Osmar. Okay. So just state your name for the
record, please. Ashley Osmer. Okay. Do you have anything to
add to the application. I don't think you. Okay. So
I'll go to the committee. Any questions. So mat. Doesn't
have any. No. Okay. So no question. So I'll move
on to the public portion. Any members of the public
