Committee Approves Multiple Variance Applications - 20 Jul 26

Good evening everyone and welcome to tonight's meeting of the Committee of Adjustment. Before we begin, I ask everyone to please silence their cell phones. If you need to take a call during the meeting, please step outside the room before answering. If you are attending in person and have an interest in the application being considered this evening, please complete one of the sign - up sheets located inside the main entrance. If you wish to receive notice of the committee's decision or be notified of any Ontario Land tribunal appeal, you must submit a written request. Those attending in person can complete the forms available at the back of the room. Those participating virtually may email our secretary treasurer, Lindsay Staman at LSTHAMAN at city of Kingston. ca. This evening will be, we will follow the same five steps process for each application. First, I will introduce the application and invite the applicant or their agent to the speaker's podium, or to speak virtually. I will ask them to state their name for the record and provide any additional information they wish the committee to consider. Next, the committee members will have an opportunity to ask questions of the applicant, their agent, or staff. Then I will open the public portion of the meeting. Members of the public will be invited to speak in person or virtually. Please state your name for the record before speaking. Each speaker will have five up to five minutes. During this portion, of the meeting, comments and questions will be received. Responses will be given once the public portion has closed. It is the fourth step that the applicant, their agent, or staff, will respond to the comments and questions received during the public portion of the meeting. Finally, the committee will consider a motion and make its decision. This process will be repeated for each application on tonight's agenda. And I will now ask The Clerk if we have quorum present. Thank you through you, Mr. Chair. I can confirm that we do have Corum absent this evening is Peter Scebo, Grevo Rohan, and Jordan Takenos Levy. Okay, thank you. So with confirmation that we have Corum, I will call the meeting to order at 532 p. m. Do we have a mover and a seconder to approve the agenda with the addendum, move by Councilloc, second by Doug. There are no returning deferrals, differral items. So moving on to business, our first item of business in an application for permission at nine Cataraqui Street. The file number is D13026 2026, and it is to build and expanded two unit dwelling on the approximate footprint of the previous dwelling. Okay, thank you. Do we have the applicant here today. Through you, Mr. Chair, to staff. I just wanted to ask a question on the recommended conditions. I don't understand, number five, what they're talking about road widening there. Through the chair, our development engineering group identified that we're deficient in the road right - of - way in that location. And so they've asked to take a three metre widening off the front of the property. And the applicant has been helpful so far in identifying that on their plans. Uh, so the city will ultimately take three metres from the front of the property, and they still have the balance of the property for their proposal. Through the chair, yeah, that's correct. The front three metres of the property would be city property. And by extension, if you see the concept plan, will the applicant is proposing to relocate the HOME three metres further back? That's part of the reason for the approximation of the location on the property. You're Mike's not on. Your mic's not on. So that's going to happen for the other people along that same stretch. Through the chair, the road - widings are generally taken at the time when the planning act application for property. So in time, it's entirely possible that the city would acquire equally on either side of a right - of - way to eventually get to the 20 metre right away. Drew, you, Mr. Chair, this is an application for permission at 102 Fraser Street. The file number is D13032 2026. And it is to allow a self - storage facility. Okay, do we have the applicant here today. Or maybe the applicants online are their agent. They're online. Okay. Okay, so can you state your name for the record. Mr. Chair. Uh, my name is Chris Pertado of CSPACE Architecture. The agent architect for this project. Um, I'm accompanied by Gregory Irons of Jim's Gate Inc. the prospective purchaser of the property. We've been working with SV planning, Inc. as well. Okay. Do you have anything to add to the application. Uh, three, Mr. Chair. I'll just lay it out quickly. Our request for zoning relief would permit the existing self - storage facility, which currently occupies approximately 1, 320 metres square of the building to expand throughout the entire structure, which is about 2, 880 metres square. The application also seeks formal recognition of the existing legal nonconforming self - storage use and permission for its expansion within the existing building. So the current use of the land were established under the M6 Industrial Zone under bylaw 8644. The current uses include an auto repair centre, a warehouse, and self - storage facility. At the time, these uses were established, Alba were permitted under the M6 zone, including the self - storage use, which was permitted as an accessory use to a permutated use. So the expansion of the self - storage used throughout the existing building. Would result in more efficient use of the property. It would consolidate the exterior signage. Architectural language established consistent operating hours for a single business and reduce overall vehicle trips, noise, odour concerns, and outdoor storage compared to the existing auto repair and warehouse uses. So these improvements would create a use that is more compatible with the surrounding area in the intended function of the lens. And retrofitting the existing building would also support its continued occupancy, minimize vacancy and make effective use of the existing infrastructure municipal services. So in conclusion, it's our opinion that establishing the self - storage use on the lens would represent a more compatible legal non - conforming use. Than the use is permitted under the URM 11 zone. And we better suited to the surrounding area. It would also reduce the traffic noise odour outdoor storage and other operational activities, minimizing potential adverse impacts upon the property, and they bring neighbouring, uh, uses and neighbours. We're thankful for the town's planning support, and we agree with the conditions listed and exhibit A. We can, uh, take any questions if you'd like. Okay, thank you. The file numbers are D1012 2026 and D13030 2026. The Minor variance application is to seek relief from the aggregate interior setbacks for each residential building for the retained and severed lot. And to reduce the minimum required interior setback for the residential building, reduce the minimum required interior setback for accessory buildings to reduce the minimum setback for architectural features and to reduce the minimum landscaped open space for the retained lot. The consent application is to sever approximately 900 square metre parcel with a lot frontage of approximately 24. 3 metres along hellent street. Okay, do we have the applicant or agent here. And the purpose of the consent is to allow both properties to be separately conveyable for two separate lots. Um, in order to facilitate the consent variance is our required for both the retained and severed lot. Um, so with respect to if the variances are required or requested, um, they are required in order to, um, several the lot. Um, the setbacks, um, which include setbacks with respect to the accessory structure, architectural features, uh, interior setbacks and landscaped open space. Right now, the current zoning by law, um, the existing setbacks don't comply with the zoning bylaws. So, um, through this report and through the variances, um, we would like to, um, bring all of these, um, elements into compliance. Um, the second question is, um, will be there at BNA changes with respect to the height. Through the application and through their planning justification, that was submitted by the applicants, no new development is proposed at this time. So there will no be exterior changes, no additional developments with respect to accessory structures or so forth. Um, so no development is proposed at this time. This application is just, uh, recognise or reestablish the previous boundaries of the original lots located at 271 and 275 Helden Street. Thank you. Okay. Well, thank you. Um. So now we are at the.
