James Street Zoning Amendment for Café - 16 Jul 26

Good evening, it's 6 p. m. so we'll begin. The meeting being held tonight is a public meeting held under the planning act. Please note that this meeting will be live streamed on the city website. Audio, video, and video are being collected by the city of Kingston and the meeting recording will be archived on the city website for public consumption. I will take this opportunity to remind everyone in the room to please ensure that the sound on your cellular device is turned off. Notice of collection, personal information collected as a result of the public meetings are collected under the Authority of the Planning Act and will be used to assist in making decision on this matter. Person speaking at the meeting or requested to give their name for recording in the minutes, all names, opinions and comments may be collected and may form part of the minutes, which will be available to the public. Tonight's meeting is to present planning applications in a public form as detailed in the community meeting report. This report does not contain a staff recommendation and therefore no decision will be made this evening. Each application in the community meeting report will be presented individually and following each presentation by the applicant. The meeting will be open to the public for comments and questions. So I'll now call the Community Meeting to Order. The purpose of the Committee meeting is to provide the applicant with an opportunity to present a potential development proposal in the early stages of development process and to seek feedback from the public and members of the Planning Committee. Anyone who attends a committee meeting may present an oral submission or provide a written submission on the proposals being presented. The application is for 10 - 14 James Street, and I invite the applicant to present the proposal. Thank you, Mr. Chair. Members of the committee, staff, members of the public. My name is Jason Sands. I'm a land use planner. And I'm working with the owners as it relates to 14 James Street. I'm accompanied by one of the owners this evening, Lindsay Foster, who will provide, co - present with myself this presentation and provide some more detail as it relates to the proposed development, and I'll handle the boring policy stuff. Overall, the proposal for the subject property is to rezone bylaw, zoning by law amendment, to application number D14002 - 2026. So the proposal is to rezone. The subject property to accommodate a cafe slash restaurant use, which as we'll talk about throughout the project, is consistent or in keeping with the neighbourhood commercial policies of the cities official plan. So the subject property is already developed, and the proposals to internally convert a portion of the building that's unutilized, not supporting the residential uses on the site to accommodate an internal seating capacity of 43 seats for that cafe use. Also with the uniqueness of a seasonal takeout type window at the front, again, building on that existing built form that already exists. In addition to that, the rear yard is a very beautiful space. There's some photography, or some photos in the slide deck, and you'll see has been a great opportunity to accommodate a rear patio. So as it relates to the proposal, what we're trying to do is, of course, change the zoning bylaw to a site - specific or a special exemption zone to allow for that neighbourhood commercial use beyond the residential uses that are on site to date. Remove a planting strip requirement. Again, you'll see in the slide deck and the photos, how there's really just not space to accommodate that to buffer the neighbouring residential use from the commercial portion of the property, as well as to permit the location of the James Street Outdoor Patio. So, next slide, please. Israelites to the location and the site information. It's a very large corner lot on the corner of James and Rito Street highlighted on the screen in red. So it's got dual frontage and wraps around essentially a residential lot fronting REDO Street. About a thousand square metres in size. The existing development on the property, as I mentioned, does accommodate two dwelling units in the existing house. And it's a residential classification. And the vacant building, which is addressed as 14 James Street, is the proposed to be internally converted to accommodate the restaurant or cafe use. That building was historically used as a shop or a garage type use to support the residential longstanding residential use on the property. Slide, please. Some existing photos, and for those of you who have had a chance, if any, to check out the Street View, Google Street View images, they look much different than the property does today in its current form, because the owners have done a significant amount of work in improving and an updating that property that was in a former state of arguably disrepair. You'll see on the left - hand side of the screen, the view from GEAME Street. So again, as I mentioned, dual frontages. The right side is essentially the view from REDO Street. And the left side is James Street. So you can see that existing building in white is the Western most portion of the property. That's the underutilized garage space that's proposed to be converted to that internal CAFA. And the west side that larger, the house, the larger peak built form. That's the one that accommodates the two residential units. Through this application, there's no proposed changes to any of that residential use that already exists on - site. Next slide, please. As mentioned, the bit of work going on as it relates to cleaning up the property. So here's some pictures of the interior yards of the property that show what the current state is as it relates to what it formerly looked like from an overgrown state. So the image on the left - hand side is looking to the west. You can see where that outdoor patio is proposed in amongst the building. And then there's some rubble and some trees, et cetera, that it's all needs to be cleaned up to function as green space or landscaped open space. The right side, again, just shows that some of that imagery of the backyard and the area that's being actively worked on. And that house that's in the background of the image, behind the red item is the one that fronts readeth Street that I mentioned earlier that this property sort of flanks. Um, and has existing privacy fences and existing trees and vegetation along the property lines. Slide, please. So just from a surrounding neighbourhood context, we didn't go too far in the imagery on the screen, but we just wanted to show in the immediate vicinity what is North South, East, West of the subject property to give you a sense as to the feeling and the area. Because as you know, it's on the corner of a fairly main street, and it's in close proxy in the Bailey, the former Bailey broom factory or the broom factory that's got some commercial uses and play off what's being proposed here. But you can see based on the images on the screen, the majority of the surrounding uses are low - density residential uses. So, uh, two - story, one and a half - story residential one to three unit type builds, uh, predominantly flank that the area. As mentioned, the Bailey Broom factory building is in close proximity. There's multiple parks. There are the woollen mill at the south end of Cataraqui Street. And this, again, is in the North Kingstown secondary plan area, which many of you are familiar with, which is proposed to be redeveloped, and the city has put some significant effort from a policy point of view into driving what that change may look like long - term. Slide, please. So this is the proposed development section. This is the site plan image of the existing situation on site. And this is a great transition for Lindsay to explain the detail of what's being contemplated. Hi there. I'm going to read. I can't outlive this one. Uh, this is, I'm here just out of a bit of personal context to this. My partner, Lawrence Van Weingarten, who's sitting over there, and I have owned and manage rental properties in the Inner Harbour for several decades. He has skillfully revived neglected buildings and brought them back to life. We have primarily focused on residential rentals, but back in 2018. We purchase what had been POTS convenience at Patrick and John Street. The store itself had been closed for several years in the property was in disrepair. That was our first foray into a commercial space. At that time, Lawrence envisioned opening a diner or some kind of eatery, a dreamy it had for years. But that wasn't a reality at that point. It was rejuvenated and then leased as a yoga studio. And then COVID happened. The space that empty for several months as we tried to figure out what to do with it. It was at that time and by chance we met Eric and Nora Peterson, who were moving back to Kingston. They were looking for a space to open a general store. It was a perfect match. And despite a raging pandemic, the Peterson's open daughter's general store and neighbourhood grocery store in October of 2020, nearly six years later, it has evolved into a community hub that offers a unique selection of comfort foods and necessities that are sourced locally from the GTA and beyond. Fast forward to 2025 when 10 - 14 James became available. I was away at the time and Lawrence messaged me about this so - called opportunity. A quick view of Google Maps and the skeptic and we sparked an eye roll or two or three. That restaurant plan of his returned in full force. He could visualize the possibilities. It took me a bit to catch up. As soon as the work started on The Property, the neighbours and passers buy immediately shared that same vision. So many people have stopped over the past year to ask about our plans for that space. There is a high demand for a restaurant in this area. Downtown restaurants are wonderful, but when you have limited time to grab a bite during your work day, walking to Princess Street is not feasible. People who work at the woollen mill, the NG building, the broom factory, readocrest, and Kingston housing and social services are all within a couple of blocks of James and Rideau. For Inner Harbour residents, including those in the MacBurney Park area, they want their own spaces. They want to walk and ride their bikes to destinations. For many, they don't even have cars. That's why daughters, the Elm Cafe and Pizza Monster are big hits. They are locally owned, easily accessible and run by people who are committed to building community. Thankfully, Eric and Nora, who share our vision, and they are committed to translating this restaurant into reality. We have formed a new partnership with this couple who have the expertise in connections to make this restaurant a success. They are also committed developing new partnerships with nearby businesses such as the broom factory to accommodate visiting artists and bike groups who want a destination rest stop meeting place. That's easily accessible from the KMP trail. It is our intent to create a warm community - centred restaurant that serves as a gathering place for families, neighbours, and local creatives in the neighbourhood. It will offer wholesome thoughtfully prepared food and drinks alongside interactive elements, such as a children's play area and community events. A seasonal walk - up soft serve ice cream counter will no doubt be a huge hit. And the outdoor space will also include, garden beds, and micro greenhouse for use in the kitchen. The four of us live and work in the Inner Harbour and recognise the need and the potential for this newly revitalized space. Thank you. Thanks, Lindsay. So this, uh, image on the slide is a conceptual site plan drawing that really just shows the existing situation of the property. As mentioned, it's an internal conversion of the Western building on the site to propose to be, or is proposed to become the cafe. There's a rear patio space that you can see. Um, as well as a front patio that may be able to be sandwiched in between the right of way associated with James Street to provide a bit of opportunity for example, so maybe somebody visiting the ice cream takeout counter to have a seat, uh, if, if, if they, if they chose. Um, so the conceptual site plan is not great detail in this regard in the fact that there's not a lot of change proposed. And I will take this moment to say that we're working through. This is a very infant stage as it relates to the approval process. We're working actively with staff on, on modifications and changes, uh, as needed. So things like garbage enclosures, walkways, landscaped open spaces, the finer details, if you will, as to how this will function and where different aspects of it will come to come to, uh, to, to, to, to exist, have ultimately not yet been finalised. So if I'm happy to answer questions on those, but as we get to them, but I just wanted to point that out if somebody's looking at the proposed development slide and trying to figure that aspect of it out. Next slide, please. Again, this is a conceptual internal floor plan of the space that's currently vacant and proposed to be internally converted to show the seating. The right hand side of the screen shows that large double door, uh, in the images on the, on the slide, it was a big yellow double door that would provide access out to that, uh, front area facing James Street with an internal seating capacity maximum 43. Your bathroom's down on the south side, uh, or the bottom slide of the image. And the kitchen at the rear. Slide, please. So from a policy point of view, we started in the province, Ontario looking at the premature planning statement, uh, so it's 2024 is the most recent. There's a host of policies that relate to the applicability of this project. You'll note section two, uh, 216 all the way through to 291 have, have some several policies that we've noted as being applicable. Um, things like introducing mixed land uses appropriate scale development that can, that can augment like Lindsay had mentioned. There's, it sounds close and relatively speaking, it might be. And somebody working in the Inner Harbour to come downtown to the core to get lunch at a restaurant. Um, but sometimes that's just a little bit far and out of their way. So for example, having a mixed use community with opportunity to have that potential in a closer setting, uh, is consistent with in our assessment, the provincial planning statement. Next slide, please. From an official plan point of view, you can see here, um, subject properties in highlighted in red. So it's on the left side of that screen, if you will, in the, in the yellow, which is the residential designation. Next slide, please. The official plan is broken to several different areas of, uh, of, of different policy regime. So housing districts, land use compatibility policies and so on. The two that I think are most important in this discussion are section 2. 7, which our land use compatibility policies as well as your section 3. 4f, which are your neighbourhood commercial policies. Again, it's a residential designation. So we understand that the acknowledgement of the overarching goal is a residential land use in that area of the city of Kingston. However, the policies do allow for appropriately scaled neighbourhood commercial typeuses. And that's what we feel is appropriate as it relates to reviewing applications such as this. So small scale neighbourhood commercial use focused on pedestrians built form that's going to drive active transportation, biceless, walking, et cetera. Um, and not be heavy dependent on vehicle use. Also just again, not to harp on this part of it in any regard. It's not a heritage building. That being said, there's an opportunity to adaptively reuse the building. Um, the owners have good experience, great experience, uh, excuse me, in this inner harbour and doing such types of development and redevelopment. And this is one that I think you can see if you again, look at the Google imagery and you look at what's been done and transform so far to date. You'll see how, how that's coming to take form. Next slide, please. So just into 2. 7. 3, the land use compatibility policies. Here are some of the key policies that we look at from a planning review point of view. And we're trying to figure out the appropriateness as to introducing a commercial type use in a residential dominated area. So increased levels of noise, dust, odour, vibration, that kind of thing. Uh, levels of traffic that can disrupt the area or the amenity of that area. Diminish service levels because there may not be area or physical infrastructure in the area to support those different and varied uses. Reduction of an ability for, for example, a neighbour to enjoy their property to what it once was for a residential abutting a residential, where if that change happens to a commercial use, is there still an ability for them to use and enjoy that property? So again, we've, we've authored a planning justification report in support of the zoning amendment and detailed these policies. But I just brought those to highlight to mention that we are of the opinion that this internal conversion. And they appropriately located patios on site are consistent with these policies to 7. 3. Next slide, please. These are the neighbourhood commercial policies. I've mentioned 3, 4f, again, gets into some of the detail about when you limit scale and how you come up with what the appropriate size or small scale convenience type uses might be appropriate. Um, and this is what's really driven us to look at where you can design the patio space. How do you get into, um, the seating capacity? How do we look at functionality with vehicular parking for staff versus vehicular parking non - existent for patrons? Um, where can we put some stuff like bicycle parking amenities, that kind of thing? So these are the policies. I'm not going to get into detail. We can come back or I can answer any questions. But we look to when we're, when we're determining whether they're appropriate uses in short, the summary that we've come up with, uh, in our assessment is that this CAFE type use, uh, and restaurant type use is appropriate from a neighbourhood commercial point of view. Next slide, please. From a zoning bylaw point of view, uh, similar to the official plan, the yellow is indicative of residential. So the UR5 is the existing zoning that applies to 10, 14 James Street. And you can see that it applies to much larger, uh, of the surrounding area on the, on the west side of Rito Street. So that type of zoning, the UR5 zoning does not allow for commercial uses as of right. And that's why we are here before the committee and Council ultimately seeking approval to introduce a special exemption to allow for that type of use. Next slide, please. From a zoning approvals point of view, in addition to the use, there are some other provisions of the zoning bylaw that are not fully compliant with, uh, and as you go through a zoning bylaw amendment approval process, it's very common that there are very provisions in the bylaw that need to be addressed through that process. So for example, planting strip, and I mentioned that one are earlier, the requirement when there's a non - residential use of budding of residential use that it be separated or buffered by a planting strip. And in this situation, we have pictures at the end of the slide deck, but in this situation, you have a narrow interior side yard that essentially doesn't allow for trees to be planted given the proximity to the neighbouring residence. Um, to flourish and actually grow. So we're proposing to remove that requirement. Um, and, and depend on fencing, uh, for buffering as opposed to planting strip requirements. So, and then outdoor patios talks about that distance three metres from a, from a lot line, uh, were proposing to reduce that to 0. 5. Restaurant, I've already mentioned is not permitted. So the cafe restaurant use is not a permitted use for pros and introduced that. And as well, rear yard setback requirement. We're proposing to recognise the existing building. So the existing building is not to be expanded or altered or, uh, enlarged in any way. We really want, we're trying to recognise that legal noncompling building location to introduce the CAFE use. Um, so that it would be fully compliant and permitted based on the new zoning. Slide, please. So in conclusion, in our assessment, the proposed development is appropriately designed. It's appropriate with respect to its scale. And it's commercial use. And as you had pointed out, there's some other commercial type uses in the area that we think this is consistent with. For example, pizza monster daughter's general. Um, some neighbourhood commercial uses that you see through at that Inner Harbour neighbourhood. The proposed developments consist with the PPS, the provincial planning statement at its highest level in Ontario's planning context, conforms to our opinion, the general intent of the, of the city's official plan based on those, those policies. Um, as mentioned, the intent of the zoning bylaw, we think is upheld given the fact that we're trying to introduce a cafe type use in a residential use. Residential neighbourhood, although that it is recognised as being appropriate located, um, and it does meet our constitute good land use planning. I think I have a couple more slides with some images, but, um, I'm happy to answer any questions. That concludes our presentation this evening. And, uh, thank you very much for the time. Um, so we're not the bad that I'm in favor of the Zooling by La Amendment request. For the new proposed use. Um. Just as far as I know, there's nothing similar in this neighbourhood. I used to live just a little bit to the west. And would walk or cycle through this area. I know it quite well. I guess very interesting plan and it's an impressive proposal. You thought about a lot of the, uh, detailed elements. I just want one question. Um, so I guess it's written down. I'll pass it to the clerk. So it's on the record. Um, I'm just wondering how close is residential property just to the south of this location. So what you're talking a little bit about, um, uh, noise amendments, noise, uh, alleviation on this kind of thing, right? So looking at a fence there. And you're talking also about, say, a bicycle parking arrow. So that's good. That was my point. Um. I hope the proposal is approved and the plan goes ahead and is successful. I'd respectfully propose that a big screen TV or two be installed with sports programs available. And my only negative comment on the presentation is I would appreciate, uh, larger font on certain of the slides. It's basically just unreadable. When you start getting into the granular detail of the amendment, uh, issues. So I'll turn this into the clerk. Um, hope you're successful when you go ahead and. Thank you. And I live in the red brick building directly across the street to the north that was shown in one of the slides. And so I just, I'm super supportive of the project. I think with the landlords have done with the project is super. It was obviously very dilapidated. It's beautiful now. The tenants that are there out in the yard. And it's a super neat neighbourhood. I've been there maybe five years. Uh, but it's sorely lacking somewhere to go to have something like this, you know, and so I downtown Kingston's great, but it's not that far, but I don't really want all these walk a kilometer. And, um, yeah, you've already got other places that are sort of similar. And the broom factory, but I think it would be, I mean, generally across the city, we sort of lack places locally that all kinds of great cities of all sizes have just in your neighbourhood where you can go and get a beer or a glass of wine, right? Whether you're in Canada or the states or Spain and just, I think it's a super great idea in the landlords have been super conscientious. So I'm, I think it's wonderful and supportive. All right. So my name is Sky Casperson and I am a resident very close to the property that the application pertains to. And I'll preface this by saying we are also very supportive of, of the changes that they've made. They've done a beautiful job. Um, and it's a very cool idea. Uh, our biggest concern we are a young family. We've got other young families in the area. Um, so I don't know if this is an appropriate stage to be asking these questions, but we are concerned about a restaurant. Will there be alcohol served? How will that be managed? Um, and then also in terms of like timing, when is the restaurant expected? As this has been figured out yet, you know, when will the restaurant operate, um, there's been some talk in the neighbourhood of potentially wanting it to be open quite late two or three a. m., which is obviously very concerning to us. Um, so I don't know if there's any substantiating of that rumour or what's going on, but those are our kind of our concerns as a young family looking to keep our roots in this area. Um, that's really all I have. Those are our questions. Can we stop. Okay. Um, anyone else online who wishes to speak. And I'll come back to the room anyone here. Change their mind. I want to say something. All right. You want to say something? Okay. All right. Thank you. Okay. So I guess we'll turn to the applicant to respond. Thank you, Mr. Chair. I don't know if we can get the picture or sort of the site plan back on the screen. I just, to address Mr. Dixon's comment on the separation distance to the neighbouring house. Whether I have it correct or not. At the pinch point, um, between the subject property and 274, uh, REDO Street is 2. 4 metres so that it's very small. And I noted the comment about increasing the tech size and the PowerPoint. That's duly noted. Thank you. But on this image, the pinch point exists between the corner. And there's already a fence. There's a privacy fence that exists there. The existing house is there. There's no changes in that corner. The only thing that that area would be utilised for is garnering access to the backyard in the future to bring garbage or any recycling out to the front, uh, to the street. So there's no new development proposing that area, but I did want to point out that, uh, that setback. The proposed patio as shown on the screen is in excess of 10 metres from any neighbouring property line. Um, and all the existing fencing does exist and is to be either maintained or upgraded through any future work on site. So that's what I had noted down with respect to Mr. Dixon's comment. Um, thank you very much for the support. We received from, from other members of the, of the, uh, audience or the members of the public, um, with respect to the questions of young family and the neighbourhood, um, alcohol being served, et cetera. Honestly, I'm not, I'm not a hundred percent sure. The alcohol aspect as well as the operations of time. There's a noise bylaw in the city of Kingston that regulates it. Um, we have done a noise feasibility study and support of the application confirming that that can be addressed at site plant control stage. But I do just want to pass it to Linziki, give you a finer details on that. Thanks Jason. Uh, no, you're not planning to stay open till two or three a. m. That is not part of the plan. It is going to be more focused on, uh, breakfast and lunch and early dinners as far as I understand. Uh, it will not be a night spot. That is not the intention whatsoever. In fact, if you know, Eric and Nora Peterson who run daughters are very family oriented. And this space will be family friendly and neighbourhood friendly for the young families that live in the area. Okay. I think that covered it all. Um, so I'll move on to the committee now. Is there any members of the committee who have any questions or comments? Councillor Steven. For deputy mayor, Steven, sorry. Thank you, Mr. Chair. Um, I really like this plan. I am a huge fan of Mixed Land use. I love that you're talking about catering to the neighbourhood, the people who actually live there, the people who work in the area, um, your talk of cyclists with the KMP trail is spot on. I've heard that actually quite a lot recently where people who like to cycle and travel are finding Kingston to be not an easy spot to get to certain places. This sounds like it might be catering to that. And I think that's brilliant. I have three questions that maybe you can answer now, maybe you can't, but I'll put them out there anyways. So my first question, it might be too early to ask this, but do you have a name yet for this restaurant. Yeah. Let's, uh. That's under discussion. No, at this point we, we tend to live. It's The Batsy and Betsy was Lawrence's mom's name. Uh, so that's tentatively what we, uh, what we have considered. Consideration. For you, Mr. Chair. That's really special. Thanks for sharing. Um, my second question was, I believe you talked about one of the properties is two residential units. Are there tenants currently living there? And if so, what's the plan there? Yes. There is, um, there's two separate units and there are tenants as of May. Uh, they, there needed to be a lot of work done on the outside and everything else along those lines to get it, uh, to get it up to snuff. And one of the tenants, also our daughter, lives on in the second unit and the other one is fully occupied as well. Okay. Thank you. Um, my last question is around the noise study. So correct me if I'm wrong, I was just re - scanning it here. I don't see anything about music. So yes, there's the city of Kingston noise by law. It would make sense. Like oftentimes restaurants have like little music in the background. Um, is that a plan for the patio like indoors? I can't see it bothering anyone. Um, but just wondering if you've talked about amplified music at all. Three, Mr. Chair. It's a great question. We discussed it with, uh, The Noise Consultant early on. And I don't, you have it in front of you. I could get it. But I don't have it in front of me. Um, if we contemplated it, there was talk about low level noise on the patio, but we ultimately created the completed the feasibility study for the zoning amendment. And the patios understanding be subject to cite plane control requirement. So we would be then getting into the deeper dive aspects of what actually happens on the patio spaces with respect to noise and putting that in sight plan. So it's something that depending on where we go with the proposal and, and where we go with the patios, the design of the patios and layout, um, we would get into that detail more so at site plan. So I know I didn't really answer your question, but it's, it's something that was considered, but is more detailed in the future. Thank you. Um, congratulations on bringing such a great idea forward. I think this will be a really cool opportunity to build community in that area. And I think you're fulfilling a real need. I'm going to first off by saying again, uh, or add to this, uh, I have been a very strong proponent of complete neighbourhoods, which this will add to that area. So, uh, thank you and welcome. I do have a few questions though. I'm not sitting a number on this cause I don't want to limit myself. Because of follow - ups. Um, now I'm not sure if I miss heard this or not at the beginning of your slide. You're showing the actual pictures of the residents or the two buildings. You mentioned the one was a resident. And it wasn't going to be changed. Now is that in reference to the actual building itself. And the interior or is that regards to it being a residence? Councillor Shaves know there is no residence being proposed in addition to what's on site today. There's existing two residential dwelling units on site on the east side of the property. Addressed as 10 James Street. They're proposed to stay. The west side of the property, the vacant portion of the building is to be converted for the cafe restaurant use with no additional residential unit. Okay. So I guess follow up on that. So it's 10 James staying as a residential and 14 being convert to a restaurant because I thought this proposal was just for a restaurant. This application. Three, Mr. Chair. Essentially, this has become going from a residential building to a mixed use building. So the two residential units will remain. In that, that one portion of the building. Okay. Which I'm fine with. I've just wanted to make sure I got it all straight. Um, okay. So 14 is going to be the restaurant. Now in re - in report. I got a little confused. Guys one sentence says no loading spaces or vehicle parking spaces are designated to be provided. However, based in the next sentence says the owners are actually actively considering options to provide a limited number of short term bicycle parking spaces and standard vehicle parking spaces within the front yard. So just a little confused about that. Will there or will there not be parking. For vehicles. Um, through you, Mr. Chair, there will be, it's proposed to be a total of four parking spaces on the property. Two of which to support the residential use. And two of which to support staff parking for the commercial use. Okay. Um, and this might be related. Or connected to. But looking at the. Concept drawing again. There seems to be a large open area. Near Reedle Street right by the intersection. Is that going to remain that way or are there plans for that area. Mr. Chair, that the large open area at the corner is to be all landscaped open space, green space associated entirely with the residential use. Uh, completely separated and segregated from the commercial. Okay. Thank you. And believe last question, it says in the report state of the garbage is going to be Brock to the street for pickup. Who's going to be responsible for picking up garbage set city or is there a private contractor. Mr. Chair, be a private contractor. That contract's already in place for the other site in which the owners operate. A commercial space in the neighbourhood. And it'd be a similar agreement with the same private collector. Okay.
